A scientific article by Levan Nanobashvili, an invited lecturer at the Law School of the University of Georgia, entitled "Legal Regulation of the Headline of the Work" was published in September 2021 in the "Georgian-German Journal of Comparative Law". The author himself will answer our questions about the work.
The research concerns the legal regulation of the title of the work. Any person can create a work. When choosing a title, it is preferable to take into account the advice given in the research. For example, if two different works have identical titles, this can mislead the public. However, the use of identical titles can be justified if the title correctly describes the content of the work (and its purpose is not to mislead the public).
The legal protection of the title of the work is not only a theoretical issue. Many disputes have arisen in different states regarding the title. The article discusses examples of judicial practices in the USA, England, Australia, and Canada.
Copyright law is a very interesting field. We have contact with copyright every day. For example, when we take a photo with a mobile phone and share it on social networks. Copyright law protects the rights of all authors, and it is desirable that all authors know what rights they have on the basis of the law. Also, how to protect these rights.
In Georgian legal literature, there is no unified approach to the issue of protecting the title of the work by copyright norms. Existing opinions are sometimes mutually exclusive. In addition, there is no judicial practice in Georgia regarding the legal regulation of the title of the work.
After the publication of the paper, I took part in the Radio Hope program, where I talked about the legal regulation of the title of the work. Also, I talked to several authors interested in this issue. I hope the article will be interesting to people interested in copyright issues. Also, for authors who think about choosing a title for a work and do not want to violate the rights of another author as a result of selection.
